Terms and Conditions for Online Ordering
All sales made by the Company are subject to the following terms and conditions.
Nothing contained within these terms and conditions affects your statutory rights as a consumer. Please read the following terms and conditions, if there is anything you don’t understand please feel free to contact us.
Our products and prices are subject to change. Promotional terms only apply in the period stated for the promotion. Whilst we will try to ensure that prices on the website are accurate, we are not responsible for errors that may occur. If we discover any errors in the price of goods before we accept your order, we will notify you as soon as possible and give you the option to resubmit your order at the correct price or cancel the order. The price of all goods and services advertised are inclusive of any applicable taxes including VAT.
Charges for delivery are not included in the stated product price.
All goods and services are subject to availability. Any product stock or availability information supplied on the website is an estimate only.
Shelf Life of Products
Our cakes are freshly baked for each order to ensure that they reach you in the best possible condition. They do not contain any preservatives and should therefore be consumed as soon as possible after receipt. If not eaten immediately they may be kept for 2 to 3 days if stored in an airtight container. Customers should keep the shelf life of cakes in mind when selecting a delivery date in advance of an occasion for which the cakes are required.
Any e-mail or other electronic acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance by Daisy Days Bakery of your order. All orders are subject to approval by us. When processing your order, the information provided will be subject to credit and fraud prevention checks. For these purposes we may transfer your information to trusted third parties.
In the event that any payment is not received or is subsequently declined, the order will not be completed or released until alternative funding arrangements have been agreed and payment is made in full.
Subsequent completion of the order will be subject to availability and cannot be guaranteed. The company accept no responsibility for any loss howsoever caused or for non-delivery under these circumstances. The customer will be responsible for the payment of any additional charges which have been incurred as a result of payment failure.
Alterations to orders
Your cakes are very important to us. Please take the time to check your order carefully and let us know within 24 hours if changes are needed. It is your responsibility to advise the Company of any alterations to the original order.
The company reserves the right to increase a quoted fee in the event that the Customer requests a variation to the work agreed.
While every effort will be made to assist Customers, please note that late changes cannot always be guaranteed.
Cake component parts
From time to time certain materials for our cakes may become obsolete or no longer be available from our suppliers, for example pre-manufactured items or ribbon colours. This is totally out of our control, however we will endeavour to re-design your order to reflect as closely as possible the original design using replacement products. In all cases we will try to contact you to advise you of any such changes, however the Company reserves the right to replace these with components of equal or better quality without consultation.
Your order may be collected at a pre-arranged time between Monday and Friday, 9.30am to 5pm. If you wish to collect outside of these times please contact us and we will do our best to help. A signature is required upon collection confirming that you have received your order in good condition and as specified. Once the order has been collected and signed for the Company is unable to accept liability for any interference with, or damage to the cake(s) thereafter.
Your order can be delivered between 2pm and 5pm Tuesday to Friday unless by prior agreement between you and the Company. All delivery times are subject to availability. If you have a specific delivery date and require delivery before a given time please specify this at the time of ordering. We will do our best to accommodate your requirements.
It is the Customer’s responsibility to ensure that you have given us correct delivery information and that someone is available to receive your order.
A signature will required at the time of delivery to confirm that your order has been received in good condition. Once the order has been delivered and signed for the Company is unable to accept liability for any interference with, or damage to the cake(s) thereafter.
If the recipient is not in the order will be returned to the Company and we will contact you to arrange an alternative delivery time for which an additional charge will be payable by the customer. The Company accepts no responsibility for any loss or consequential loss incurred by the customer as a result.
Cancellations and refunds
Cancellations must be made in writing
Orders over £25.00 – full payment is required if cancellation is within 72 hours of delivery, prior to this a refund of any monies paid, less 25%, will be made.
Orders of £25.00 or under – full refund of any monies paid will be made provided that we are notified of cancellation prior to attempting delivery. No refunds will be made in the event that we are not notified of cancellation or where no-one has been available to accept delivery of your order.
Please note that no person shall have entitlement to copy or reproduce in any form, or otherwise make use of any image, photograph, design or other document or item produced by or on behalf of the Company without the prior written consent of the Company.
Publication and promotional rights
By placing an order the Customer agrees that the Company is the sole designer and owner of the final cake design. All rights to any original designs created and designed by the Company shall remain the exclusive property of the Company. From time to time our designs may be published in the media. We reserve the right to use any image of a Customer’s cake(s) made by the Company for publication after the delivery date unless previously agreed n writing between the Customer and the Company.
The Customer has no ownership rights over any cake design. Exclusivity of our cake designs between our Customers is not guaranteed unless the Customer commissions an exclusive design.
Please be aware that whilst your chosen cake(s) may not be made with nuts or a nut product, all orders are prepared in a kitchen where nut products may be used. Raw materials used may not be free from dairy, wheat or gluten.
Please advise the Company of any allergies prior to ordering in order that we may discuss with you how we can best meet your needs.
Allergy information is provided with all cake orders.
Cake stands are available to hire should these be required by the Customer. In addition to any hire charges, a refundable deposit will be required to cover the cost of repair or replacement of the hired items should loss or damage occur. Full terms and conditions for the hire of equipment will be provided.
Daisy Days Bakery’s liability for any injury (other than death or personal injury), damage or loss, in particular consequential loss, arising from the use of any goods purchased via this website, or from the transaction itself, are hereby excluded. Any injury, damage or loss arising directly from the negligence of Daisy Days Bakery or any of its agents will be limited to a refund of the value of the goods purchased, together with any delivery charges paid.
